What this site is

JoinJMG.com exists so licensed real estate professionals can learn about joining The Jason Mitchell Group and tell us they’re interested. That’s it. It’s an information and inquiry site — not a portal, not an application system, and not a place to transact.

By using this site, you agree to these Terms, including the arbitration agreement and class action waiver below. If you don’t, please don’t use it.

This site is operated by JMG Holding Partners LLC, doing business as The Jason Mitchell Group (“JMG”), 3080 N Civic Center Plaza, Scottsdale, AZ 85251. Real estate brokerage services are provided by separately licensed JMG affiliated brokerage entities; licensing disclosures are at justia.com/real-estate/home-ownership/real-estate-forms-50-state-resources. Each affiliated entity, and each of JMG’s affiliates, officers, directors, employees and contractors, is an intended third-party beneficiary of the sections of these Terms addressing liability, disclaimers and dispute resolution, and may enforce them directly.

What happens when you fill out the form

You give us your contact information and a bit about your business. We use it to reach out and have a conversation about whether JMG is a fit. A recruiter or team leader will follow up.

Submitting the form doesn’t commit either of us to anything. It isn’t an offer, an application, or an agreement to affiliate. Nothing binds either party until there’s a signed agreement — and that agreement, not this page, will govern the terms of any relationship with JMG.

Contacting you

Submitting the form means we can email or call you about your inquiry — that’s the point of submitting it.

Automated calls and texts are separate and optional. They require your affirmative consent, given by checking the box below, which is unchecked by default:

Opting out of marketing doesn’t stop us from replying to a question you asked.

Your consent covers JMG and its affiliated brokerages only, and any agent matched to you by JMG. If a third party would contact you, we’d ask you separately.

Calls may be monitored or recorded for quality and training, consistent with applicable law.

Your data

We use the information you provide to evaluate fit, follow up with you, and run and improve this site. We don’t use it for unrelated purposes. We don’t sell it. Our Privacy Policy has the full detail, including how to request access or deletion, and it applies to this site.

If you don’t end up joining, we may keep your information for a reasonable period in case circumstances change. Ask us to delete it and we will, except where we’re required to keep something — for example, a record of a consent you gave us, or records we have to retain by law.

Fair play

The site itself

Content here is provided as-is for general informational purposes and may change or be removed at any time. It isn’t legal, tax, or financial advice.

The JMG name, logo, and program names are our trademarks. Partner names and logos belong to those partners and are not licensed to you.

How these Terms fit together. These Terms govern your use of JoinJMG.com. If you go on to affiliate with JMG, the JMG Terms of Service and your signed agreement will govern that relationship, and your signed agreement controls where it conflicts with either set of terms.

The fine print. You must be at least 18 years old and legally able to enter a binding contract to use this site. If any part of these Terms is held invalid, the rest stays in force. If we don’t enforce a provision right away, we haven’t waived it. You may not assign these Terms; we may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets. We may send notices to the email or phone number you provide; send legal notices to 2720 East Camelback Road, Suite 280, Phoenix, Arizona 85016.

If something goes wrong

To the maximum extent permitted by law, JMG’s total liability arising from your use of this site is limited to $500, and JMG is not liable for indirect, incidental, or consequential damages, including lost profits or lost business opportunity.

These Terms are governed by the laws of the State of Arizona. Disputes are resolved under the provisions below.

Informal resolution first. Before filing a claim, contact us at mv@clglawaz.com with a written description of the dispute and the relief you want. We’ll try in good faith to resolve it within 30 days.

Arbitration and Class Action Waiver — Please Review Carefully. If we can’t resolve it informally, any dispute arising out of or relating to this site or these Terms will be resolved by final and binding individual arbitration administered by AAA under its Consumer Arbitration Rules, before one arbitrator, seated in Maricopa County, Arizona. The Federal Arbitration Act governs this section. You and JMG waive the right to a jury trial and the right to participate in a class, collective, consolidated, or representative action. The arbitrator may award relief only on an individual basis, except as provided below.

Public injunctive relief. Nothing in this section waives any non-waivable right to seek public injunctive relief. A claim for public injunctive relief may be brought in court, is not subject to arbitration, and is not subject to the class action waiver. If a court determines that this paragraph is unenforceable, that claim is severed and proceeds in court while all other claims remain in arbitration.

Delegation. The arbitrator, and not any court, has exclusive authority to resolve any dispute about the interpretation, applicability, enforceability, or formation of this arbitration agreement, including any claim that it is void or voidable — except that a court decides the enforceability of the class action waiver and of the paragraph above.

Coordinated filings. If 25 or more demands for arbitration raising substantially similar claims are filed by or with the assistance of the same or coordinated counsel within a 90-day period, the demands will be administered in sequential batches of no more than 50, with a single arbitrator per batch, and the parties will select two demands from the first batch to proceed as bellwethers. Limitations periods are tolled for any demand awaiting a batch, and any demand not assigned to a batch within twelve (12) months of filing may be brought in court at the claimant’s election.

Exceptions and opt-out. Either party may bring a claim in small claims court, and either party may seek injunctive relief in court to protect intellectual property. Nothing in this section limits your right to file a complaint with a government agency or a state real estate regulator, or to participate in an arbitration or ethics proceeding required by an Association of REALTORS®. You may opt out of arbitration by writing to info@jasonmitchellgroup.com within 30 days of first accepting these Terms; opting out does not affect anything else in these Terms.

Severability. If any part of this section is found unenforceable, that part is severed and the remainder remains in effect, except that if the class action waiver is found unenforceable as to a particular claim, that claim proceeds in court.

Time limit. Any claim must be brought within one (1) year of the date it accrued, or it is permanently barred — except that where applicable law provides a longer period that cannot be shortened by agreement, that longer period applies. Time spent in the informal resolution process above does not count against this period.

Nothing here limits liability for fraud, gross negligence, willful misconduct, or anything else that can’t be limited by law.

Changes

We update these Terms occasionally. Continued use of the site means you accept the current version. Material changes get a new effective date.
